Overview
Illinois enacted one of the most ambitious cannabis expungement programs in the country through the Cannabis Regulation and Tax Act of 2019. The law mandated automatic expungement of records for possession of 30 grams or less and created a petition-based process for larger amounts. Governor JB Pritzker granted over 11,000 individual pardons for low-level cannabis offenses, and the Illinois State Police was tasked with identifying and processing approximately 770,000 eligible records for automatic expungement. The program was designed to address the disproportionate impact of cannabis enforcement on communities of color. Illinois also invested cannabis tax revenue into communities most affected by the war on drugs through its R3 (Restore, Reinvest, Renew) program.
