Overview
New Jersey enacted one of the most comprehensive automatic cannabis expungement programs in the nation through the CREAMM Act of 2021. The law mandated automatic vacation and dismissal of pending charges, as well as expungement of prior convictions, for a wide range of cannabis offenses including possession, distribution of small amounts, and being under the influence. An estimated 360,000 records are eligible for automatic processing by the Administrative Office of the Courts. The law also prohibits employers and educational institutions from considering expunged cannabis records.
