Cannabis is partially legal in Arkansas, with medical marijuana authorized since 2016 but recreational use remaining prohibited. Arkansas voters approved Issue 6 (the Arkansas Medical Marijuana Amendment) in November 2016 with 53.2% support, making it the 26th state to legalize medical cannabis.
Under Arkansas's medical marijuana program, patients with qualifying conditions can possess up to 2.5 ounces of cannabis every 14 days. The state recognizes 18 qualifying conditions including cancer, PTSD, severe arthritis, fibromyalgia, glaucoma, positive HIV/AIDS status, seizures, and chronic pain. Patients must obtain a registry identification card from the Arkansas Department of Health, which costs $50 annually.
The Arkansas Medical Marijuana Commission oversees the regulated market, which launched in 2019. The state initially licensed 8 cultivation facilities and 40 dispensaries, though not all have opened. As of 2024, Arkansas has generated over $100 million in medical marijuana sales tax revenue, with a 6.5% state tax on medical cannabis sales plus local taxes.
Recreational marijuana remains illegal with criminal penalties. Possession of less than 4 ounces is a misdemeanor punishable by up to one year in jail and fines up to $2,500. Larger amounts carry felony charges with potential prison sentences.
In November 2022, Arkansas voters rejected Issue 4, which would have legalized recreational marijuana for adults 21 and older. The measure failed with 56.2% voting against it, making Arkansas one of five states to reject recreational legalization that election cycle.
Cannabis cultivation, distribution, and possession outside the regulated medical system remain criminal offenses. The state does not recognize medical marijuana cards from other states, requiring Arkansas residency for program participation.
